La CCIP-CA a retenu la validité d’une clause de conciliation préalable obligatoire mais rejeté la fin de non-recevoir tirée du non-respect de cette clause au motif que la notification du litige avait bien été faite par courriel et que la phase de résolution amiable de 30 jours avait été respectée.

Elle a également rejeté la fin de non-recevoir tirée de l’estoppel, au motif que l’option ouverte par l’article 1217 du code civil permettait au demandeur de formuler par conclusions en première instance une demande nouvelle, à titre principal, sur ce fondement, sans que cela ne constitue une contradiction de posture ni une mauvaise foi procédurale.

La cour a confirmé que la grève de la centrale de Gardanne était constitutive d’une force majeure selon les critères fixés par le contrat, excluant l’exigence d’imprévisibilité, et, validant son caractère irrésistible, a confirmé la décision des premiers juges qui en ont retenu le caractère libératoire.

The ICCP-CA considered valid a mandatory prior conciliation clause, but rejected the plea of inadmissibility based on the failure to respect that clause, on the ground that the litigation had duly been notified by e-mail and that the 30-days alternative dispute resolution phase had been respected.

The court also rejected  the plea of inadmissibility based on estoppel, on the ground that the option provided by article 1217 of the Civil Code allowed the plaintiff to formulate a new primary claim, by submissions in first instance, on this ground, without it being considered as inconsistant or procedural bad faith.

The court confirmed that the Gardanne’s power station strike created a Force Majeure according to the criteria provided by  the contract, excluding the unforeseeability condition, and,  by confirming its irresistible nature, corroborated the decision of the first judges who had retained the discharching effect of the strike.
