1.1. Challenge of arbitral award – the court’s assessment of the tribunal’s decision to conduct a hearing remotely despite one party’s objection

1.1.1. An arbitral tribunal decided to conduct the final hearing remotely, despite the respondent’s objections. The respondent subsequently challenged the award, arguing that the tribunal’s decision constituted a procedural error. In particular, the respondent argued that the remote hearing violated its right to an oral hearing under Section 24 of the Swedish Arbitration Act and Section 32 of the SCC Arbitration Rules.
1.1.2. Section 24 of the Swedish Arbitration Act provides that the arbitrators shall give the parties the opportunity to present their case in writing or orally, as appropriate.
